In these Terms & Conditions, “Rchery Lifestyle”, “Socx”, “we”, “us” and “our” refer to Socx operating under the Rchery Lifestyle brand.

2. Application of these terms

These Terms & Conditions apply to all offers, orders and agreements made through rcherylifestyle.eu.

Before placing an order, you will be given an opportunity to read and accept these Terms & Conditions. If you do not agree to them, you should not place an order.

Any departure from these terms is only valid if we have agreed to it in writing.

Nothing in these terms limits any mandatory rights you have under applicable consumer law.

3. Our products

We make reasonable efforts to describe and display our products accurately. Product images are illustrative. Colours may appear slightly different depending on your screen, lighting, materials and the production process.

Product measurements and size charts are approximate. Minor variations that do not affect the normal use or overall character of the product do not constitute a defect.

You are responsible for reviewing the selected product, size, colour, quantity and personalisation details before submitting your order.

4. Personalised products

Certain products can be personalised using a name or other text provided by you.

You are responsible for ensuring that all personalisation details are complete, accurate and correctly spelled. We will normally produce the product using the information exactly as submitted.

A product made according to your specifications or clearly personalised is excluded from the statutory right of withdrawal. It cannot be returned or exchanged because you changed your mind, selected the wrong size or supplied incorrect personalisation details.

If you contact us before production has started, we may be able to change or cancel a personalised order, but we cannot guarantee this.

The exclusion from withdrawal does not affect your rights if a personalised product is defective, damaged, incorrectly produced or does not correspond to the accepted order.

You must not submit personalisation content that:

  • Infringes another person’s intellectual-property or other rights;

  • Is unlawful, discriminatory, threatening or offensive;

  • Misrepresents an identity or affiliation; or

  • Is otherwise unsuitable for production.

We may reject or cancel an order containing such content. If we cancel before producing the product, we will refund the amount paid for that product.

5. Prices

All prices displayed to consumers include applicable VAT unless clearly stated otherwise.

Any collection, delivery or additional service costs will be displayed before you place the order.

We may change prices at any time, but a price change will not affect an order that we have already accepted.

Obvious pricing, description or technical errors are not binding. If an obvious error affects your order, we will contact you and give you the choice of confirming the order using the corrected information or receiving a refund.

6. Placing an order

You place an order by completing the online checkout and clicking the button that confirms an obligation to pay.

After placing an order, you will receive an electronic acknowledgement. This acknowledgement confirms that we received your order but does not necessarily mean that we have accepted it.

The purchase agreement is concluded when we expressly accept the order, confirm that it is being processed, or begin production or fulfilment.

We may refuse or cancel an order when:

  • The product is unavailable;

  • Payment is not authorised or completed;

  • The order information appears incorrect or incomplete;

  • We reasonably suspect fraud or misuse;

  • The requested personalisation is unlawful or unsuitable;

  • An obvious pricing or description error has occurred; or

  • We cannot reasonably fulfil the order.

If we cancel an order after payment, we will refund the relevant amount.

7. Payment

Payments are processed through Mollie. Available payment methods may include PayPal, card payments or other methods presented during checkout.

Your use of a payment method may also be subject to the terms and privacy policy of Mollie and the relevant payment provider.

An order does not have to be produced, reserved, delivered or made available for collection until payment has been completed, unless we expressly agree otherwise.

We do not normally receive or store your complete card or bank-account credentials.

8. Pre-orders

Products offered as pre-orders are produced or reserved for future fulfilment.

The product page, website or order confirmation will indicate the expected collection or delivery arrangements. Dates are estimates unless we expressly confirm that a date is guaranteed.

We will inform you if we become aware of a material delay. Where mandatory law gives you a right to cancel because of a delay, these Terms & Conditions do not restrict that right.

Personalised pre-orders remain subject to the personalised-product provisions in section 4.

9. Collection at the JVD Open

Where event collection is selected, orders can be collected from the designated JVD Open merchandise location during the communicated opening hours.

We will normally send a collection notification to the email address used for the order. You may be asked to show your order confirmation, collection notification or identification.

Another person may collect the order on your behalf if they can show the order confirmation or collection notification.

You are responsible for providing a working email address and checking your messages, including your spam folder.

If you cannot collect your order, please contact us as soon as possible at info@rcherylifestyle.eu.

Where we agree to ship an order that was originally intended for collection, additional shipping and handling costs may apply. We will inform you of those costs and may send a separate invoice or payment link. Shipment will take place after the additional amount has been paid.

10. Delivery

Where delivery is offered, you must provide a complete and accurate delivery address.

Delivery times are estimates unless a specific delivery deadline has been expressly agreed. We are not responsible for a delay caused by inaccurate customer information or circumstances outside our reasonable control, but this does not affect your mandatory consumer rights.

Risk of loss or damage normally passes to a consumer when the consumer, or a person designated by the consumer, physically receives the goods.

If a parcel is returned because the address supplied was incorrect, incomplete or inaccessible, we may charge the reasonable cost of resending it.

11. Right of withdrawal

Consumers generally have a statutory right to withdraw from an online purchase of a standard, non-personalised product within 14 days after receiving or collecting it, without giving a reason.

This right does not apply to goods made according to the consumer’s specifications or goods that are clearly personalised.

12. Inspection and returns

During the withdrawal period, you may inspect a standard product to the extent reasonably necessary to establish its nature, characteristics and functioning, as you would normally be allowed to do in a physical shop.

You may be responsible for diminished value resulting from handling beyond what is necessary for that inspection.

Unless the product is defective, incorrect or damaged on delivery, the direct cost of returning a product is your responsibility.

Please consult our Returns & Refunds Policy before returning a product.

13. Defective, damaged or incorrect products

Products must conform to the agreement and meet the standards that consumers may reasonably expect under applicable law.

If you receive a defective, damaged or incorrect product, contact us promptly at info@rcherylifestyle.eu and include:

  • Your order number;

  • A description of the issue; and

  • Photographs where these can reasonably demonstrate the problem.

Depending on the circumstances and your statutory rights, we may offer repair, replacement, completion, a price reduction or a refund.

We will bear reasonable return costs where a product is defective, damaged, incorrectly supplied or incorrectly personalised due to our error.

Nothing in these Terms & Conditions excludes or restricts your statutory rights relating to product conformity or legal guarantees.

Include your contact details, order number and a clear description of the complaint.

We aim to acknowledge complaints promptly and provide a substantive response within 14 days. If more time is reasonably required, we will inform you.

15. Intellectual property

Unless otherwise stated, the website and its content—including text, graphics, logos, product designs, photographs and layout—are owned by or licensed to Socx and are protected by intellectual-property law.

You may use the website for personal, non-commercial shopping purposes. You may not reproduce, distribute, modify or commercially exploit its content without prior written permission.

Third-party names, event names, logos and trademarks remain the property of their respective owners.

16. Website availability

We try to keep the website accurate, secure and available. We do not guarantee uninterrupted or error-free access.

We may suspend or change parts of the website for maintenance, security, legal or operational reasons.

17. Liability

We are responsible for loss or damage to the extent required by applicable law.

We are not liable for losses caused by:

  • Incorrect information supplied by you;

  • Use of a product contrary to its intended purpose or care instructions;

  • Events outside our reasonable control; or

  • Unauthorised or unlawful personalisation content submitted by you.

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for intentional misconduct or any mandatory consumer right.

18. Privacy and cookies

We process personal data in accordance with our Privacy Policy.

Information about cookies and similar technologies is provided in our Cookie Policy and cookie settings.

19. Changes to these terms

We may update these Terms & Conditions from time to time.

The version applicable to an order is the version made available when the order was placed. Changes do not retrospectively alter an existing purchase agreement.

20. Governing law

These Terms & Conditions and agreements with Socx are governed by Dutch law.

If you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections that apply in your country of residence.

Disputes may be submitted to a competent court under applicable law. We encourage you to contact us first so that we can attempt to resolve the matter directly.
